Fees and Expenses

Points of Attention Relating to Representation Aid

In addition to retainer fees and expenses paid by the JLSC on your behalf upon the commencement of the aid, you are to pay remuneration for attorneys-at law or judicial scriveners depending on the outcome of the case.

  • Remuneration is payable except for certain cases, such as the case where you lost the case in its entirety.
  • Remuneration is payable as long as any legal, positive outcome is generated, even you fail to obtain any payments from parties including the opposing party to the case.
  • For example, generally, you must pay remuneration even when (i) only divorce was legally granted and you could not obtain any payment or (ii) a lawsuit has been brought against you and even a partial dismissal was achieved.
  • The amount of remuneration shall be decided by the JLSC considering various factors, including the type and nature of the case and the amount of the financial benefits you received.
  • If you receive any money, etc. from the opposing party, etc., remuneration shall be paid from such money in principle.

The amount written below is only for reference purpose. The actual amount is to be determined depending on the type and complexity of the case and other factors. The amount may be increased in the process of or at the conclusion of the case. Further, the JLSC may make payment of additional expenses on your behalf.

Monetary claim case

Ex. The plaintiff instituted a claim for repayment of loan in the amount of one million yen, and received payment of one million yen.

* The amount of retainer fees and remunerations may be increased depending on various factors, including the complexity of the case. The above amounts are standard amounts.
* As a general rule, if you receive money from the opposing party in the case, the outstanding amount of loan and remunerations to be additionally payable is to be paid in full from the money received. In the case of representation aid like the above, the JLSC will not make advanced payment of compensations.

Expenses for interpretation and translation in relation to case handling of representation aid and documentation aid

If any interpretation or translation becomes necessary in relation to the case handling, the JLSC pays the fees on your behalf and you are liable to make the repayment to the JLSC. If you receive payment from the opposing party to the case, you may be asked to pay the fees directly instead of the JLSC making the payment for you. No additional loans are available for interpretation and translation fees incurred before the decision to grant the aid, so you are requested to pay these fees directly to the relevant service providers.
The following is the standard of payment of expenses:

Standard for interpretation and translation service fees

(1) Interpretation fees

(a) Unit price

The interpretation fees are loaned up to 12,570 yen (including transportation expenses and consumption tax) for the first one hour of each meeting or court hearing that require interpretation service, plus the amount up to 5,237 yen (including consumption tax) for each additional 30 minutes.

(b) Limitation

The maximum aggregate amount of loan for interpretation fees is 104,761 yen (including consumption tax) per legal aid case. Interpretation fees in excess of this amount are not covered by the JLSC's loan program, and you need to make direct payment to the relevant service provider. The method of payment will be determined for each instance.

(c) Prepayment (yo-no-kin) to court

If the interpretation fees are included in the prepayment to the court, the JLSC will make the payment on your behalf separately from the interpretation fees up to the maximum additional loan amount.

(d) Other

Interpretation fees include a per-diem allowance, transportation expenses, etc. payable to an interpreter, but additional transportation expenses may be incurred in case where long-distance transportation is needed.

(2) Translation fees

Translation fees are expenses necessary for translation between different languages.

(a) Unit price

The unit price of translation fees is up to 4,713 yen (including consumption tax) for original texts in one sheet of A4 size paper.

(b) Limitation

The maximum aggregate amount of loan for translation fees is 104,761 yen (including consumption tax) per legal aid case. Translation fees in excess of this amount are not covered by the JLSC's loan program, and you need to make direct payment to the relevant service provider. The method of payment will be determined for each instance.
