Support for Victims of Crime

In this service, we collect contact information for local consultation in cooperation with organizations and groups that provide support to crime victims, and refer crime victims to organizations or groups that offer the support they need.
We also provide victims and their family members with information that contributes to their utilization of systems for proper participation in criminal proceedings and the recovery of damages and alleviation of victim suffering, as well as other systems for assistance.
In addition, when victims wish to have the support of an attorney, such as legal consultations, we will refer them to an attorney. As for legal fees, depending on their financial status, they can take advantage of the civil legal aid service offered by the JLSC or Aid Services entrusted by the Japan Federation of Bar Associations.

1. Providing Information on Victim Support
We provide crime victims and their family members with information on support to crime victims,
including referring them to consultation services that support to crime victims and providing them with information on legal systems available to them, according to their situation and needs after they have been harmed, free of charge.
2. Referral to Attorney
If you need advice or support from a legal expert, we will refer you to an attorney with experience and understanding in support to crime victims in light of your situation.

Homicide, criminal assault, injury, forcible sexual intercourse and other similar crimes, forcible indecency, domestic violence, abuse, stalking, fatal traffic accident, hit-and-run and other similar cases.
3. Assistance Systems for Attorney’s Fees and Other Expenses
If you meet certain requirements, including in terms of the amount of your assets (please note that each assistance system has different requirements), you are entitled to utilize various assistance systems for attorney’s fees and other expenses through the JLSC.

If you do not speak Japanese, please contact the multilingual information service (0570-078377), which provides a three-party telephone conference service with a JLSC employee and an interpreter.
The service is available in the following languages: English, Chinese, Korean, Spanish, Portuguese, Vietnamese, Tagalog, Nepali and Thai.

Assistance Systems for Attorney’s Fees and Other Expenses

* If you meet certain requirements, you are entitled to utilize the assistance systems.

Legal Consultation Aid for Victims of Domestic Violence and Other Offences

Attorneys provide legal consultation services for those who are suffering from domestic violence, stalking or child abuse, regardless of their financial resources.

● The victims themselves can meet and speak with an attorney to seek legal consultation
(The legal consultation service is not available to victims’ agents).
● They can seek consultation on both criminal and civil affairs if they need to do so to prevent their suffering.
* If you are unable to arrange your own foreign language interpreter although you need one at the time of the consultation, we will provide you with an interpreter service. Please contact one of our District Offices for details.

Please note that if you have assets exceeding the following standard, you will be asked to pay a consultation fee (5,500 yen) later.

< Asset Standard >
The total amount of cash and savings that can freely be used by the person who wishes to utilize a legal consultation service must not exceed three million yen at the time of the consultation.
* The costs that are expected to be incurred within one year from the date of the legal consultation as a result of domestic violence, stalking, child abuse or other offense (e.g., treatment cost) will be deducted from the sum of the cash and savings.

● Legal Consultation Aid
If you meet certain requirements, you are entitled to receive legal consultation services free of charge from an attorney or a judicial scrivener for a civil, family or administrative case.
● Representation and Documentation Aid
If you meet certain requirements, on your behalf, we will pay attorney’s fees and other expenses required for the in-court procedures of a civil, family or administrative case.

Entrusted Service by the Japan Federation Bar Associations

● Legal Aid for Crime Victims
Victims of homicide, injury, sexual crimes, stalking or other similar crimes and their family members are entitled to receive support for attorney’s fees and other expenses incurred in criminal proceedings, proceedings for juvenile decision and administrative procedures.*
● Legal Aid for Children
Children (under the age of 20) requiring the protection of human rights due to child abuse, etc. are entitled to receive support for attorney’s fees and other expenses incurred in the negotiation with an administrative organ conducted on their behalf, legal procedures performed on their behalf or other similar matters.*
*Please apply for support via the attorney you intend to engage.

Court-Appointed Attorney System for Participating Victims

● System for Victims to Participate in Trials
This is a system that allows a victim of a certain crime, etc. to participate in a criminal trial based on a decision of a court so that the victim can be present in court on a trial date and ask the defendant questions.

< Persons Eligible to Participate in Proceedings as a Victim >
(ⅰ) Crimes that have caused death or injury due to intentional criminal acts (e.g., homicide and injury);
(ⅱ) Crimes of forcible indecency, forcible sexual intercourse, etc., indecency by a person having custody of a person under 18 and other similar crimes;
(ⅲ) Crimes of unlawful capture and confinement;
(ⅳ) Crimes of kidnapping by force or by enticement and human trafficking;
(ⅴ) Other crimes that include the criminal acts listed in items (ii) through (iv);
(ⅵ) Crimes of negligent driving causing death or injury and other similar crimes; and
(ⅶ) Attempts to commit any of the crimes listed in items (i) through (v)

The following persons are eligible to participate in trials as victims: the victims themselves of any of the crimes listed in items (i) through (vii) above and their statutory agents as well as the spouses, lineal relatives and siblings of the crime victims if the victims themselves have died or suffered serious physical or mental harm.

● Court-Appointed Attorney System for Participating Victims
This is a system under which a court appoints a court-appointed attorney for participating victims and the national government bears the costs therefor in order to enable a participating victim who cannot afford to bear the costs to receive the support of an attorney (attorney for a participating victim).

< Conditions of Use >
If you wish to use the system as a participating victim, the amount of your financial resources (the total amount of cash, deposits and other assets) less the costs that are expected to be incurred within six months as a result of the criminal act (e.g., treatment cost) must be less than two million yen.

Reimbursement of Transportation Cost to the Participating Victims

This is a system under which the national government pays transportation and other costs for those who participate in criminal trials by using the system for victims to participate in trials. Any participating victim may apply for reimbursement of the costs, regardless of their financial resources or other factors.

The national government pays their transportation cost (travel expenses) and a daily allowance as well as accommodation expenses in the case where they need accommodation because they participate in a trial that is to be held in a court located far from their residence or for any other similar reason.
